1. About these terms

These terms govern the supply of the Aiva service by Less Native Ltd ("Aiva", "we", "us") to a business customer ("you"). By using Aiva, you agree to these terms. If you are agreeing on behalf of a business, you confirm you are authorised to do so.

2. Business-to-business only

Aiva is provided exclusively to businesses for use in their trade or profession. It is a B2B service. We do not provide Aiva to consumers, and consumer contract rights do not apply. Nothing in these terms is intended to create a consumer relationship.

3. The service

Aiva answers calls a business is unable to take, replies to the caller by SMS, and works to qualify and book the resulting lead on the business's behalf. The service is delivered using a dedicated phone number and depends on third-party telecoms providers (see our Privacy Policy). We aim to keep the service available at all times but do not guarantee uninterrupted operation.

4. Your responsibilities

  • Provide accurate business information (services, pricing, availability) so Aiva can represent you correctly.
  • Use the service lawfully and not for any unlawful, misleading or abusive messaging.
  • Meet your own data protection obligations to your customers, for whom you are the data controller.
  • Honour the bookings and commitments Aiva makes with your customers on your behalf.

5. Fees and payment

Aiva is provided on a subscription basis. Pricing is agreed with you before your account goes live. Fees are billed in advance for each billing period unless agreed otherwise. All fees are exclusive of VAT where applicable.

6. 30-day money-back guarantee

We offer a 30-day money-back guarantee from the date your account goes live. If, within those first 30 days, Aiva has not generated more value than it cost — or you are simply not happy — you may request a full refund of the fees paid for that period, and we will return them. The guarantee applies once per business. It covers Aiva subscription fees and does not extend to third-party charges incurred outside the service. 7. Cancellation

There is no fixed-term contract. You may cancel at any time, and cancellation takes effect at the end of your current billing period. We do not charge a cancellation fee. On cancellation, your dedicated number and active conversations will be deactivated; tell us in advance if number portability is required.

8. Limitation of liability

Aiva supports your business but does not guarantee any particular volume of leads, bookings or revenue. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss arising from third-party telecoms failures. Our total liability to you in connection with the service is limited to the fees you paid in the 12 months preceding the claim. Nothing in these terms excludes liability that cannot be excluded by law.

9. Suspension and termination

We may suspend or end the service if these terms are breached, if fees are unpaid, or if continued operation would be unlawful. We will give reasonable notice where we can.

10. Governing law

These terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
